Arguments in appeal of Marijuana Act to appear before state Supreme Court

HELENA – The Montana Cannabis Industry Association and others have filed a lawsuit challenging the 2011 Montana Marijuana Act (SB 423). They argue the new law violates their constitutional rights to pursue health, a livelihood and privacy.

In a preliminary ruling, the District Court issued an injunction delaying implementation of several provisions of the Act pending final resolution of the lawsuit. The State of Montana appeals from the District Court’s prohibition of enforcement of the Act’s provisions (1) limiting a provider to supplying three users and (2) precluding providers from accepting reimbursement. The State also asks the Court to clarify the correct standard to be used for constitutional analysis of challenged provisions of the Act.

The oral arguments are open to the public; however seating is limited. The arguments will be available for viewing in the lobby of the State Law Library, on the ground floor of the Court’s building.
